SECTION 4: APPEAL of AHA
CURRENT STATUS: JUDICIAL REVIEW & APPEAL UPHELD CITY COUNCIL'S DECISION
A number of neighbors in the Section 4 neighborhood of 89015 individually filed requests for judicial review and this was reviewed by multiple judges. The judicial review process and subsequent appeals were denied and the court upheld the city council's original decision. READ ON FOR NEXT STEPS
About The American Hindu Association (AHA) Project in Section 4
The American Hindu Association's Projected Anand Utsav Mandir - Temple Complex will destroy the character of our neighborhood. They are intending on building a complex that is not permitted in our RNP that would include:
A Main Residence • A Secondary Residence
A Multi-Family Residence • A Multi-Purpose/Gymnasium Building
A Storage Building • A Main Temple
6 Festivals Annually (2 for 24 hours) • 105 Parking Spaces

This facility would host festivals at least 6 times per year. At their current location they boast on social media that they have 100 people show on a rainy day and 500 people attend their regular service. In the project paperwork submitted for approval by the City of Henderson they state that they "anticipate" 20 people, which is blatantly misleading. As part of their argument they state that other churches are already within our RNP. Those other houses of worship were there before our RNP was put into place AND they are on the perimeter/outside edges of our RNP. The proposed location for this project is on an internal street with non-continuous streets in 6 directions. The slippery slope of allowing ANY public use facility within our RNP is that our land is cheaper than appropriate lands (this is by design in an RNP) and that it would open the flood gates to turn us into a mixed community and destroy our way of life. Please contact us and talk to your neighbors as the city is attempting to push this through without hearing our voices.

NEXT STEPS
The appeal was a necessary next step in an attempt to have the city council's decision overturned. Currently the decision they made, granting a conditional use permit, is upheld. The AHA has a permit to begin construction that has an expiration date, at which time they will need to get an extension and may be required to submit their project. Should they complete construction and be allowed to occupy their space they will have a review of their CUP after a calendar year from that date.
